§ 1 Rental Property and Keys
The landlord rents to the tenant a holiday apartment in Ehrwald.
The house rules displayed in the rental property apply. The property is a non-smoking accommodation.
The property is furnished according to the features listed on our website (www.hausleonard.com).
The tenant receives one key for the duration of the rental period.
§ 2 Rental Period, Arrival and Departure
The property is rented to the tenant for the period agreed in the booking form.
Arrival is possible from 4:00 PM on the day of arrival.
Departure must take place by 9:30 AM on the day of departure.
At the end of the rental period, the tenant must vacate the property, leave it in proper condition, and return the keys to the landlord.
§ 3 Rental Price and Payment Terms
The rental price is agreed according to the season and booking period.
Electricity, water, internet, and heating are included in the rental price.
Additional costs: local tourist tax and environmental contribution, guest card, final cleaning.
Payment terms:
A deposit (30% of the rental price) must be transferred within 10 days after conclusion of the contract.
The remaining balance must be paid no later than 2 weeks before the start of the rental period.
If less than 14 days remain between booking and arrival, the full amount is due immediately.
By agreement, the remaining balance may be paid in cash upon arrival.
Tourist tax, environmental contribution, guest card, final cleaning, and pet fees (if applicable) must be paid in cash upon arrival.
If the tenant is more than 14 days in arrears with payment, the landlord may terminate the contract without further notice and re-rent the property.
A security deposit of €250 must be paid in cash upon arrival.
§ 4 Cancellation and Early Departure
A rental agreement is concluded for the duration of the stay.
If the tenant cancels before arrival, the following cancellation fees apply (unless the property can be re-rented):
Up to 49 days before arrival: 30% of the rental price
Up to 21 days before arrival: 60%
Up to 14 days before arrival: 90%
Less than 14 days before arrival: 100%
The landlord will attempt to re-rent the property.
In case of late arrival or early departure, the full rental price remains payable.
Cancellation must be made in writing. The date of receipt by the landlord is decisive.
§ 5 Liability and Obligations of the Tenant
The property, furniture, and all items must be treated with care.
The tenant is responsible for ensuring that accompanying persons and visitors do the same.
The tenant is liable for any damage caused by themselves or accompanying persons to the property, furnishings, or other items (e.g., keys), up to the full replacement value.
The tenant is also liable for loss of items from the property, regardless of insurance coverage.
Defects discovered at check-in or during the stay must be reported immediately and compensated on site at replacement value.
Pets are not allowed in the property.
House rules: The tenant agrees to comply with the house rules available in the property.
§ 6 Rights of the Landlord
The landlord reserves the right to enter the property when necessary, for example:
intermediate cleaning
linen change
waste disposal
non-compliance with house rules
closing windows
urgent maintenance or repairs
severe weather or imminent danger
force majeure
§ 7 Use of Internet Access via Wi-Fi
1) Permission to Use Wi-Fi
The landlord provides internet access via Wi-Fi.
Use is permitted free of charge for the duration of the stay and may be revoked at any time.
The tenant may not allow third parties to use the Wi-Fi.
No guarantee is given for availability, suitability, or reliability of the connection.
The landlord may restrict or suspend access at any time and block certain websites or services (e.g., illegal, violent, pornographic, or paid content).
2) Access Data
Access is granted using a Wi-Fi key.
The key is for personal use only and must not be shared.
The tenant must keep it confidential.
The landlord may change the key at any time.
3) Risks of Wi-Fi Use and Limitation of Liability
Wi-Fi provides internet access only; no virus protection or firewall is provided.
Data transmission may be unencrypted and visible to third parties.
Use is at the tenant’s own risk.
The landlord is not liable for damage to the tenant’s devices unless caused intentionally or by gross negligence.
4) Responsibility and Indemnification
The tenant is responsible for all data transmitted, services used, and legal transactions conducted via the Wi-Fi.
The tenant must comply with all applicable laws and in particular must not:
access or distribute illegal or immoral content
violate copyright laws
ignore youth protection regulations
send offensive, defamatory, or threatening messages
use Wi-Fi for spam or unauthorized advertising
The tenant shall indemnify the landlord against all third-party claims resulting from unlawful use of the Wi-Fi, including legal costs.
If the tenant becomes aware of any violation, they must inform the landlord immediately.
§ 8 Termination of the Rental
In addition to termination at the end of the agreed rental period, the landlord may terminate the contract immediately if:
the tenant uses the property in a significantly harmful manner
the tenant behaves in a way that makes cohabitation unreasonable
the tenant commits a criminal offense against property, morality, or personal safety
the tenant fails to pay the invoice despite a reasonable deadline
§ 9 Written Form, Severability, Jurisdiction
Amendments or additions to the contract must be made in writing.
This also applies to any waiver of the written form requirement.
If any provision is invalid or unenforceable, the validity of the remaining provisions remains unaffected.
The invalid provision shall be replaced by a valid one that most closely reflects the original intent.
This contract is governed by the laws of the Republic of Austria.
Place of jurisdiction is Reutte, Tyrol.
